Terms & Conditions of Sale and Supply
GSE Elevator Solutions (ABN 73 157 676 394)
11. General & Application
1.1. These Terms and Conditions (“Terms”) apply to all quotes, sales, custom manufacturing, supply, and installation services provided by GSE Elevator (“GSE”, “we”, “us”, or “our”) to the customer (“Customer” or “you”).
1.2. These Terms apply across GSE’s full range of products and services, including but not limited to custom lift protection blankets, site timber protection cladding, lift mirror and glass replacement, Premium Architectural Vinyl Lift Wraps, studs/hooks hardware, and associated on-site installation, survey, and removal services.
1.3. By accepting a quotation, paying an invoice, submitting a Lift Blanket Customer Measure Form, issuing a purchase order, or approving custom drawings/proofs, you agree to be bound by these Terms.
2. Quotations, Pricing & Payment
2.1. Quotations remain valid for 30 days from the date of issue unless otherwise specified in writing.
2.2. All prices quoted are in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) unless explicitly stated.
2.3. Payment Terms: Full payment of the invoice (or agreed deposit/milestone payments for commercial accounts and staged works) is required prior to the commencement of shop drawings, custom manufacturing, material procurement, or dispatch.
2.4. Orders will not enter the production schedule until full payment or the agreed stage deposit is received in cleared funds and custom drawings or scope details are approved.
2.5. Material Cost Fluctuation & Staged Procurement: Quoted prices are based on material costs at the time of quotation. For multi-stage, phased, or long-term projects extending over multiple months—or where materials are procured in stages rather than in full prior to project commencement—GSE reserves the right to adjust unit pricing on unprocured materials/stages to reflect significant supplier or market material cost increases. GSE will provide notification and supporting justification prior to procuring materials for subsequent stages.
3. Measurements, Specifications & Drawing Approval
3.1. Customer Measurements: Customer-supplied measurements via our Lift Blanket Customer Measure Form or site plans constitute the sole basis for manufacturing. The Customer is entirely responsible for the accuracy of all dimensions, cutout locations, button positions, floor positions, and lift details submitted.
3.2. GSE Site Surveys: Where GSE is engaged to conduct site measurements or surveys (e.g. for glass, vinyl wraps, or timber cladding), the Customer must ensure unrestricted access to the lift car during the agreed survey window.
3.3. Drawing & Proof Sign-Off: GSE will provide custom drawings or visual design proofs based on the details submitted. Manufacturing or graphic production will only commence once written approval is received from the Customer.
3.4. Corrections & Revisions: Once drawings or proofs are approved, any subsequent alterations requested by the Customer may incur additional charges and will alter production timelines.
3.5. Error Liability: GSE accepts no liability or responsibility for blankets, timber, glass, or vinyl wraps manufactured or printed incorrectly due to inaccurate measurements, incomplete details, or erroneous sign-offs provided by the Customer.
4. Custom Manufacturing & Production Lead Times
4.1. Custom Goods: All Lift Protection Blankets, timber cladding panels, safety glass, and Premium Vinyl Lift Wraps are custom made-to-order products tailored to specific lift dimensions and specifications.
4.2. Lead Times: Our standard manufacturing lead time is 7–10 business days (unless a different timeline is specified in writing for specialised or large-scale works).
4.3. Commencement of Lead Time: Lead times commence strictly after both (a) full invoice payment (or agreed deposit) is received, and (b) written approval of manufacturing drawings, colour proofs, or scope is provided by the Customer.
4.4. Delays: GSE will make every reasonable effort to meet quoted delivery dates but shall not be held liable for delays caused by force majeure, material supply shortages, courier issues, or delayed client approvals.
5. Delivery & On-Site Worksite Requirements
5.1. Delivery: Delivery is made to the single address specified in the quote and email correspondence. Delivery is deemed complete upon drop-off at the ground floor/loading dock unless otherwise agreed in writing.
5.2. Site Access & Prerequisites: Where stud installation, timber cladding, mirror replacement, vinyl wrapping, or site delivery is included:
The Customer must ensure safe, clear, and unobstructed access to the lift car and work area during agreed times.
If required, the lift must be isolated, parked, and made safely available exclusively for our installation team.
The Customer is responsible for securing any necessary site inductions, parking permits, loading dock access, lift booking slots, and building manager approvals prior to our team's arrival.
5.3. Substrate Condition: For mirror replacement or vinyl wrap application, existing lift car surfaces must be clean, dry, structurally sound, and free from rust, oil, silicone, wax, or severe surface damage prior to installation.
5.4. Abortive Site Visits: If our installation team attends the site and cannot perform work due to lack of access, site safety hazards, unbooked lifts, unready substrates, or incomplete site preparation, a re-attendance visit fee will apply.
5.5. On-Site Delays & Interruption Charges: If GSE technicians experience delays, downtime, or workflow interruptions caused by events outside our direct control—including but not limited to delayed site entry, extended site induction hold-ups, interference or obstruction by other trades, restricted lift availability, unready substrates, lack of power/lighting, or on-site scope variations requested by the client—GSE reserves the right to charge standing time and additional hourly labour rates.
5.6. After-Hours & Weekend Work Rates: Standard work is conducted during standard business hours (Monday to Friday, 7:00 AM – 3:30 PM). Where the Customer requests or requires work to be performed outside standard hours (after-hours, night shifts, weekends, or public holidays), labour rates will be adjusted upward to reflect penalty rates in accordance with relevant Fair Work Ombudsman Award standards.
6. Premium Vinyl Lift Wraps Terms
Where Premium Architectural Vinyl Lift Wraps are supplied and applied:
6.1. Surface Suitability & Preparation: Vinyl wraps require flat, non-porous, smooth, and fully cured substrates. GSE is not liable for vinyl lifting, bubbling, or failure caused by unstable underlying paint, corrosion, moisture ingress, or un-gassed substrate materials.
6.2. Environmental Conditions: Site conditions must be climate-controlled where required to meet manufacturer installation temperature requirements. Extreme temperatures or high dust environments during installation may require rescheduling.
6.3. Design & Colour Matching: Vinyl wraps, metallic finishes, and woodgrain textures are produced to supplier specifications. Minor colour variation may occur between digital proofs, screen previews, and physical vinyl runs.
6.4. Care & Maintenance: Vinyl wrapped surfaces must only be cleaned using mild soapy water and microfibre cloths. Using harsh chemicals, abrasive pads, solvent cleaners, or high-pressure washers will void all product warranties.
7. Timber Protection Cladding Terms
Where timber lift protection cladding (plywood protection for lift walls, door frames, handrails, or floors) is supplied and installed:
7.1. Timber protection cladding is designed as a temporary protective barrier during construction, fitout, or removal works.
7.2. Ownership, Removal & Disposal: Upon supply and installation, all timber protection materials become the property of the Customer. The Customer is responsible for the ongoing maintenance, removal, and disposal of the timber cladding upon completion of their project. At the Customer’s request, GSE may, at its sole discretion, agree to assist with the removal or collect and reclaim select reusable timber materials from the site.
7.3. Site Protection & Alterations: The Customer must ensure site personnel, trades, or contractors do not alter, modify, or vandalise timber panels during the protection period.
7.4. Scheduling Removal Services: Any requests for GSE to assist with timber removal or collect reusable materials must be scheduled in advance and may be subject to additional service fees.
8. Cancellation & Returns
8.1. Non-Cancellable Orders: Because all products (blankets, timber, glass, vinyl wraps) are custom manufactured or custom-cut to bespoke specifications, orders cannot be cancelled, returned, or refunded once drawing/proof approval has been given and production, printing, or material cutting has commenced.
8.2. Pre-Production Cancellations: If an order is cancelled prior to drawing/proof approval, GSE reserves the right to charge an administration fee, drawing/design fee, and any incurred material procurement costs to cover work performed to date.
9. Warranty & Defects
9.1. Manufacturer’s Warranty: GSE warrants that custom Lift Protection Blankets, vinyl wraps, and supplied goods will be free from defects in materials and workmanship for a period of 12 months from the date of supply or installation.
9.2. Exclusions: This warranty does not cover:
Fair wear and tear from standard site use, heavy construction impacts, sharp trade tools, scratches, or harsh chemical exposure.
Misuse, improper cleaning, improper installation (if not installed by GSE), improper storage, or third-party modification.
Incorrect sizing arising from customer-supplied measurement errors.
9.3. Defect Claims: Any claim for defective workmanship, incorrect dimensions (not matching approved drawings), or missing components must be reported in writing within 7 days of delivery or installation, including photographic evidence.
9.4. Australian Consumer Law: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy implied by the Competition and Consumer Act 2010 (Cth).
10. Limitation of Liability
10.1. To the maximum extent permitted by law, GSE’s liability for any breach of these Terms or statutory guarantees is limited, at our option, to:
Re-supplying or repairing the affected goods/services; or
Refunding the cost of the affected goods or services.
10.2. Under no circumstances will GSE be liable for any indirect, consequential, special, or liquidated damages, including loss of project time, building access penalties, tenant disputes, or site delays.
11. Title & Risk
11.1. Risk in the goods passes to the Customer upon delivery to the specified site address or completion of installation.
11.2. Title to all goods remains with GSE Elevator Solutions until payment for the goods has been received in full.
12. Governing Law
12.1. These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of NSW.
